Terms and conditions

These conditions of sale are concluded on the one hand by the Fondation Maeght whose head office is located at 623 chemin des Gardettes – 06570 Saint Paul, registered with the Register of Commerce and Companies of Grasse under number 782 636 500 00012 hereafter referred to as “the Maeght Foundation” and managing the fondation-maeght.com website and, on the other hand, by any natural or legal person wishing to make a purchase via the fondation-maeght.com website, hereinafter referred to as “the Buyer “.

1. Object

These general conditions of sale (hereinafter referred to as “GTC”) are intended to define the commercial relations between the Fondation Maeght boutique (hereinafter referred to as the “Boutique of the Maeght Foundation”) and the buyer and the conditions applicable to any purchase made on the website of the Maeght Foundation (fondation-maeght.com).
Before any transaction, the buyer declares on the one hand that the purchase of products on the site fondation-maeght.com is not directly related to its professional activity and is limited to a strictly personal use and on the other hand have full legal capacity, allowing it to agree to these general terms and conditions of sale.
The Maeght Foundation retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site.
Therefore, the applicable conditions will be those in force on the date of the order by the buyer.
The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale, of which the buyer acknowledges having read prior to his order.
The general conditions of sale (hereinafter referred to as “GTC”) apply to all commercial relations between the Maeght Foundation boutique (hereinafter referred to as “Maeght Foundation Boutique”) and its customers, in the version in force at the time of the contract signature.
Any order placed constitutes express acceptance of these GCS by the customer.
These T&Cs apply to the exclusion of any other document. The customer’s conditions, contrary or deviating from these T&Cs, are not recognized by the Boutique of Fondation Maeght.

2. Rates

The prices appearing on the product sheets of the internet catalog and are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable in France on the day of the order. All change in the VAT rate may be passed on to the price of the products.
The Maeght Foundation reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
Delivery costs are calculated based on the delivery postal code and the weight of the items.

3. Order and terms of payment

The Maeght Foundation offers buyers the option of ordering and paying for their products in several stages
:
Secure payment by credit card via the STRIPE system: the buyer selects the products he wishes to order in the “basket”, modify if necessary (quantities, references, etc.), check the delivery address or enter a new one. Then, the buyer chooses the mode of payment of his choice.
The next step offers him to check all the information, read and accept the present general conditions of sale by checking the corresponding box, then the prompt to validate his order by clicking on the button “Confirm my order”. Finally, the buyer is redirected to the secure STRIPE interface in order to securely enter their card references personal banking. If the payment is accepted, the order is registered and the contract definitely formed.
Payment by credit card is irrevocable. In case of fraudulent use of it, the buyer may demand the cancellation of the payment by card, the sums paid will then be credited or refunded.

The responsibility of the holder of a bank card is not engaged if the disputed payment has been proven to have been carried out fraudulently, remotely, without physical use of his card. To get the reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest, in writing, the debit with his bank, within 70 days following the operation, or even 120 days if the contract binding him to it so provides. The amounts withdrawn are reimbursed by the bank within a maximum period of one month after receipt of the dispute writing formed by the bearer. No cost of restitution of the sums can be charged to the incumbent. The confirmation of an order entails acceptance of these conditions of sale, the acknowledgment of having perfect knowledge of it and the renunciation of taking advantage of its own purchase conditions. All the data provided and the recorded confirmation will be worth proof of the transaction. If the buyer has an e-mail address and if he has entered it on his order, the Maeght Foundation will communicate to him by e-mail the confirmation of registration of his order. 4. Retention of title

The Maeght Foundation retains full ownership of the products sold until the perfect collection of the price, in principal, costs and taxes included.

5. Livraison

Deliveries are made to the address indicated on the order form.
Deliveries are made by La Poste via the Colissimo service. Delivery times are not given for information only. The Maeght Foundation may provide the purchaser by e-mail with the tracking his package. The buyer is delivered to his home against delivery with signature.
If the buyer is absent, he will receive a delivery notice from his postman, which will allow him to collect the products ordered from the nearest post office, for a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment where the items leave the premises of the Maeght Foundation. The buyer is required to check in the presence of the employee of La Poste or the delivery person, the condition of the packaging of the goods and their contents at the delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery

6. Return policy

Article L221-23 provides that the consumer returns or returns the goods to the professional, without excessive delay and, at the latest, within 14 days following the communication of its decision to retract.

Return costs remain the responsibility of the consumer.
Once received, the returned items will be refunded at the price in effect at the time of the order on the credit card used for the purchase.

7. Liability

The Foundation Maeght, in the distance selling process, is only bound by an obligation to means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, disruption of service, or other problems involuntary.

8. Intellectual Property

All elements of the fondation-maeght.com site are and remain the intellectual property and exclusively from the Maeght Foundation.

9. Personal data

The Maeght Foundation undertakes to preserve the confidentiality of the information provided by the buyer, which he would be required to transmit for the use of certain services. 10. Settlement of disputes

These distance selling conditions are subject to French law.
